GPsite provides a platform for independent general practitioners to create and maintain their own professional website. By creating an account, subscribing to our service, or using our platform, you agree to be bound by these terms and conditions.
GPsite is operated from Australia and these terms are governed by Australian law. If you're accessing our service from outside Australia, you're responsible for ensuring your use complies with local laws.
When you create an account with GPsite, you must provide accurate and complete information. You're responsible for maintaining the security of your account and password, and for all activities that occur under your account.
You must notify us immediately if you suspect any unauthorised access to your account. We're not liable for any loss or damage arising from your failure to maintain account security.
You must be at least 18 years old and legally able to enter into contracts to use this service. If you're using the service on behalf of a practice or organisation, you confirm you have authority to bind that entity to these terms.
GPsite operates on a subscription basis. When you subscribe, you agree to pay the fees for your chosen plan. All fees are in Australian dollars (AUD) and include GST where applicable.
Billing and Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorise us to charge your nominated payment method for each renewal period.
Price Changes: We may change our pricing with at least 30 days' notice. Price changes won't affect your current billing period but will apply from your next renewal.
Failed Payments: If a payment fails, we'll try to collect again. If we can't collect payment after reasonable attempts, we may suspend or terminate your service. You remain liable for any outstanding amounts.
Refunds: We offer refunds at our discretion. Generally, fees paid are non-refundable except where required by Australian Consumer Law. If you cancel mid-billing period, you'll continue to have access until the end of that period, but no refund will be provided for unused time.
You are responsible for maintaining accurate and up-to-date information about your medical practice, including your qualifications, practice locations, and contact details.

We reserve the right to monitor your use of the service to ensure compliance with these terms, though we're under no obligation to do so.
We will provide you with a platform to display your professional information. We will maintain the technical infrastructure and use reasonable efforts to ensure your site remains accessible.
Service Availability: We aim to provide a reliable service, but we don't guarantee uninterrupted access. We may need to suspend the service for maintenance, updates, or emergency repairs. We'll try to give advance notice for planned maintenance where practical.
What We Don't Do: We are not responsible for the accuracy of the information you provide, and we do not verify your credentials, qualifications, or right to practice. We're not a medical services provider and don't provide medical advice.
Changes to Service: We may add, modify, or discontinue features of our service. If we make significant changes that materially reduce functionality, we'll notify you in advance.
Your Content: You retain ownership of the information and content you provide. By using our service, you grant us a non-exclusive, worldwide licence to use, store, display, and transmit your content solely for the purpose of operating and providing the service to you.
Our Property: The GPsite platform, including its design, features, functionality, code, and all related intellectual property rights, remains our property. You're granted a limited, non-exclusive, non-transferable licence to use the service during your subscription period.
You must not copy, modify, reverse engineer, or attempt to extract the source code of our platform. Our trademarks, logos, and brand elements may not be used without our written permission.
We collect and use your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By using our service, you consent to such processing and warrant that all data you provide is accurate.
We implement reasonable security measures to protect your data, but no internet transmission is completely secure. You acknowledge this inherent risk when using our service.
If you're collecting patient information through your site (such as appointment requests), you're responsible for complying with privacy laws and obtaining necessary consents.
Our service may integrate with or link to third-party services (such as payment processors, mapping services, or communication tools). We're not responsible for these third-party services, their availability, or their terms.
Your use of third-party services is governed by their own terms and conditions. We don't endorse or make any warranties about third-party services.
You Can Cancel: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You remain responsible for charges incurred before cancellation.
We Can Suspend or Terminate: We reserve the right to suspend or terminate your account immediately if you:
We may also terminate your account with 30 days' notice for any reason, in which case we'll provide a pro-rata refund for any prepaid fees.
After Termination: Upon termination, your right to use the service stops immediately. Your website will be taken offline. We'll make reasonable efforts to provide you with access to export your data for 30 days after termination, after which we may delete it. We're not obligated to retain your data beyond this period.
We provide the service "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We don't warrant that:
Australian Consumer Law: Nothing in these terms excludes, restricts, or modifies any consumer guarantees, warranties, or other rights you may have under the Australian Consumer Law (ACL) or other laws that cannot be excluded. If the ACL applies and we breach a consumer guarantee, our liability is limited to, at our option: resupplying the services or paying the cost of having them resupplied.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the service.
Our total liability to you for all claims arising from or related to the service is limited to the amount you paid us in the 12 months before the claim arose, or $100 AUD, whichever is greater.
These limitations apply even if we've been advised of the possibility of such damages. Some jurisdictions don't allow these limitations, so they may not apply to you.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
You agree to indemnify, defend, and hold harmless GPsite, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

Governing Law: These terms are governed by the laws of the State of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
Disputes: If a dispute arises, we encourage you to first contact us at support@gpsite.com.au to try to resolve it informally. If we can't resolve the dispute within 30 days, either party may pursue formal resolution.
Before commencing court proceedings, you agree to attempt to resolve the dispute through mediation in accordance with the Australian Disputes Centre mediation rules, unless the dispute is urgent or requires immediate injunctive relief.
We're not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.
We may update these terms from time to time. If we make material changes, we'll notify you by email or through a notice on the service at least 30 days before the changes take effect.
Your continued use of the service after the changes take effect means you accept the new terms. If you don't agree with the changes, you can cancel your subscription before they take effect.
We'll update the "Last updated" date at the bottom of this page when we make changes.
Entire Agreement: These terms, together with our Privacy Policy, constitute the entire agreement between you and GPsite regarding the service.
Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these terms doesn't constitute a waiver of that right or provision.
Assignment: You may not assign or transfer these terms or your account without our written consent. We may assign these terms to any affiliate or in connection with a merger or sale of our business.
No Agency: Nothing in these terms creates a partnership, joint venture, or agency relationship between you and us.
Notices: We may provide notices to you via email to the address you provided, or through the service. You must provide notices to us in writing to support@gpsite.com.au
